Broadway - The Festival - Terms and conditions
TERMS & CONDITIONS, CANCELLATION POLICY & LIABILITY WAIVER

By purchasing, accepting, or using a ticket to The Festival (the “Event”), you agree to the following Terms & Conditions. Please read carefully.
1. Ticket License. Each ticket is a revocable license granting the holder admission to the Event. The Festival reserves the right to revoke this license at any time for violation of these Terms without refund. Tickets may not be used for contests, promotions, or commercial purposes without prior written consent.
2. Rain or Shine. The Event is rain or shine. Performances may proceed during inclement weather unless conditions pose a safety risk as determined by Event management in its sole discretion. No refunds or exchanges will be issued due to weather conditions, including delays, interruptions, or shortened performances.
3. All Sales Final / No Refunds. ALL SALES ARE FINAL. NO REFUNDS, EXCHANGES, OR CANCELLATIONS. This includes but is not limited to:
- Personal scheduling conflicts
- Travel disruptions
- Illness (except as required by applicable law)
- Artist lineup changes
- Weather conditions
4. Artist Lineup & Schedule Changes. Artist lineup, set times, programming, and Festival experiences are subject to change without notice. No refund or exchange will be issued in the event of:
- Artist cancellation
- Schedule changes
- Modified set length
- Substitutions
- VIP experience adjustments due to illness, travel delays, security needs, or force majeure
No specific artist appearance or performance length is guaranteed.
5. Postponement / Force Majeure. If the Event is postponed due to circumstances beyond the Festival’s reasonable control, including but not limited to:
- Acts of God
- Severe weather
- Government orders or restrictions
- Public health emergencies
- Labor disputes
- Terrorism
- Power outages
- Artist travel disruptions
Tickets will be valid for the rescheduled date. If the Event cannot be rescheduled, the Festival may, at its sole discretion, provide either: - A refund of the face value of the ticket (excluding service fees), or
- A credit toward a future Festival event.
The Festival shall not be liable for travel, lodging, transportation, or other incidental expenses.
6. Assumption of Risk. Attendance at the Event involves inherent risks, including but not limited to:
- Loud amplified sound
- Crowds and crowd movement
- Uneven terrain
- Weather exposure
- Heat or sun exposure
- Slips, trips, and falls
- Alcohol consumption by others
- Infectious disease exposure
By attending, you voluntarily assume all risks, known and unknown, associated with the Event.
7. Release & Waiver of Liability. To the fullest extent permitted by law, you release and hold harmless: The Festival, its producers, owners, affiliates, sponsors, venue, artists, contractors, vendors, and employees from any and all claims, damages, losses, or liabilities arising from:
- Personal injury
- Illness
- Property damage
- Death
- Theft
- Emotional distress
- except to the extent caused by gross negligence or willful misconduct.
8. Security & Conduct. All attendees may be subject to security screening, including bag checks. Prohibited items include but are not limited to:
- Weapons of any kind
- Illegal substances
- Outside alcohol
- Drones
- Professional recording equipment (without credentials)
The Festival reserves the right to: - Refuse entry
- Remove attendees
- Deny re-entry
- for disruptive, unsafe, illegal, or inappropriate behavior, as determined by the Event’s staff in its sole discretion — without refund.
9. Photography & Media Release. By attending, you grant the Festival and its designees the irrevocable right to photograph, record, and use your image, likeness, voice, and name in any media worldwide, in perpetuity, without compensation.
10. Health & Safety. Attendees agree to comply with all health, safety, and emergency procedures implemented by the Festival or venue. The Festival may modify operations to comply with applicable laws or safety requirements.
11. Accessibility. The Festival is committed to accessibility. Attendees requiring accommodations should contact Access@BroadwayFest.com prior to the Event.
12. Resale & Fraud. Tickets obtained from unauthorized sources may be invalid. Duplicated or altered tickets will not be honored.The Festival reserves the right to cancel tickets suspected of fraudulent activity.
13. Payment Plans. If purchasing through an installment plan:
Missed payments may result in cancellation of your ticket.Previously paid installments are non-refundable. Ticket access will not be issued until payment is completed.
14. Limitation of Liability. In no event shall the Festival’s liability exceed the face value of the ticket purchased. The Festival shall not be liable for indirect, incidental, special, or consequential damages.
15. Dispute Resolution. Any dispute arising from these Terms or attendance at the Event shall be resolved through binding arbitration in the State of New York, County of New York. Attendees waive the right to participate in any class action lawsuit.
16. Governing Law. These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
17. Agreement. By purchasing a ticket, you acknowledge that you have read, understood, and agreed to these Terms & Conditions, including the waiver and release of liability.

American Express® Card Members have access to purchase Amex Presale Tickets® for select events and select seats, during a specified period prior to the general on-sale dates for those events. Tickets must be purchased using an American Express Card. An American Express Prepaid Card cannot be used to purchase tickets. Amex Presale Tickets® are sold by and fulfilled by third-party ticket sellers (not American Express), and such tickets are subject to the rules, terms and conditions, prices and fees set by the ticket seller, event promoter and/or the venue. Amex Presale Tickets® are subject to availability and supply may be limited. Not all seats may be offered; purchase limits and blackout dates may apply.
